Terms and Conditions of Service/ Vehicle Compliance Waiver: 

**By the installation of this product and or service from "AKTIV TUNING GROUP PLT", you, as the "Customer", indicates that you had read and fully understands this agreement and accepts its terms and conditions and enter into this Waiver/Release. Do not use this product until you have carefully read the following agreement. This agreement sets forth the terms and conditions for the use of the performance product and/or service. **

DISCLAIMER Performance Products and Service

Read carefully before installing any performance product and/or service. This is a high-performance product and service. Use at your own risk. Products and Service are for off road use only. Use of any Aktiv Tuning Group PLT product and/or service on public roads and/or used on any emissions controlled vehicles is prohibited.

DISCLAIMER Performance Warranty

By installing this Product and/or Service, Customer Understands and Agrees that as a performance product and/or service, individual results may vary depending on make, model, and usage. Aktiv Tuning Group PLT shall in no way be held responsible nor liable for any of the results, claimed or otherwise, that may or may not come from the product or service. Customer also understand that the original vehicle manufacturer makes its own determinations regarding the effects of Add-On products and/or service to its warranties, Aktiv Tuning Group PLT shall in no way be held responsible nor liable for anything pertaining to or resulting from the original vehicle manufacturers warranty and/or terms of use. This Product and/or service interfere with and should be removed from the vehicle before any diagnostic testing.

DISCLAIMER OF LIABILITY

Aktiv Tuning Group PLT, its distributors or dealers shall in no way be responsible for the products proper use and service. The buyer of this system hereby waives all liability claims. The buyer acknowledges that he is not relying on the sellers skill or judgment to select or furnish goods and/or services suitable for any particular purpose and that there are no liabilities which extend beyond the description on the face hereof, and the buyer hereby waives all remedies or liabilities, expressed or implied arising by law or otherwise, (including without obligations of the seller with respect fitness, merchantability and consequential damages) or whether or not occasioned by the seller’s negligence. The seller disclaims any warranty and expressly disclaims any liability for personal injury or damages. The buyer acknowledges and agrees that the disclaimer of any liability for personal injury is a material term for this agreement and the buyer agrees to indemnify the seller and to hold the seller harmless from any claim related to the item of the equipment or service purchased. Under no circumstances will the seller be liable for any damages or expenses by reason of use or sales of any such equipment and/or service. The seller assumes no liability regarding the improper installation or misapplication of its products and/or services. It is the installer’s responsibility to check for proper installation and if in doubt the manufacturer is to be contacted.

DISCLAIMER Performance Products and Service Warranty

By installing this Product and/or Service, Customer Understands and Agrees that Aktiv Tuning Group PLT offers no warranty, refunds or returns on any high performance product and/or service, shipping & handling charges and/or processing fees. Customers are responsible for insuring any items shipped to the company.

Aktiv Tuning Group PLT reserves the right to suspend or revoke Serial Suite Kit/Tuning Capabilities to any non compliant Dealer Location/Tuning Center for any reason to protect the Aktiv Tuning Group PLT brand and policies as well as protecting all companies, dealers, affiliates and customers involved.

1.    As the “Customer” I hereby represent that I have read and completed the required procedures and checks and that I have full authority to authorize the testing/tuning of this vehicle and to enter into this Waiver/Release

2.    As the “Customer” I am aware that all tests are intended to be and will be at maximum performance and at wide-open throttle, thus applying stress similar to that which the vehicle would experience during operation on the road/track and is therefore susceptible to the same risks as on the road/track which may cause engine, power train and/or tire/wheel failure or damage.

3.    As the “Customer” I know and accept the risk of tuning my vehicle.

4.    As the “Customer” I hereby represent that I know the condition of the vehicle and I assure that it is in acceptable condition to submit to tuning. I have been advised that Aktiv Tuning Group PLT does not know, nor assumes any such knowledge of the condition of the vehicle being tested/tuned and I nevertheless, agree to have my vehicle submitted to tuning. As the “Customer” I represent that all parts of the vehicle are in good condition and are capable of full power and full throttle performance during any testing/tuning performed.

5.    Therefore, As the “Customer” I hereby release Aktiv Tuning Group PLT from any liability of any nature for damage or other losses which may be sustained as a result of the testing/tuning during the tuning session.
